Dont Speak, No Doubt.

This is a very very good song and i just love it. Its only recently (OK. the recently is today) that I had a chance to look at the lyrics. I thought it had very beautiful lyrics. But then when I actually attempted to sing along, I found it very hard. Boy!!! such a difficult piece of writing to make music to.

But then, all said and done the credit should go to the lyricist, musician and singer, the only female in the band (don’t ask me who else, other than lyricist, musician and singer is needed to create a song – thot I will be a bit generous when it comes to compliments :-)). Gwen Renee Stefani, the vocalist has done a good job of it (I was impressed with the video, the first time I saw it, bcos of the pottu aka bindi that she had on her forehead). If you guys haven’t listened to the song, please do listen to it. It’s a wonderful song!!!!

Heyy, english songs really have a different sense of rhyme and tunefulness i guess. If you read the lyrics of Simon and Garfunkel and MLTR and then listen to those songs you will be amazed how certain words have been set to tune. The words are always sung quite differently from our expectations!!

Legal Notice

I act on behalf of the Frescomoraine Ltd, a company (which is to be) duly incorporated in accordance with the laws of the Republic of India.

It has recently been brought to our attention that you have posted the lyrics of a song which is copyrighted.

The use of lyrics which is not in the public domain, has not been authorized by the legal owner of the copyright.

Copyright:

As per US copyright law, Section 102(a) provides copyright protection - "Copyright protection subsists, in accordance with this title, in original works of authorship fixed in any tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device"

To be specific Section 102(a)(2) "the musical works, including any accompanying words;" is copyrighted.

Copyright Protection:
As per Section 106(5), only the owner of copyright has the exclusive right "in the case of literary, musical, dramatic, and choreographic works, pantomimes, and pictorial, graphic, or sculptural works, including the individual images of a motion picture or other audiovisual work, to display the copyrighted work publicly"

Since this blog isn’t meant for "criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research", as per Section 107, you are not eligible for exemption from copyright laws.

Cease And Desist:By violating the Section 106, as per Section 501, you are deemed to be an "infringer of the copyright".

We herein formally inform you to cease and desist from posting such copyrighted material in your blog. Further all copyrighted material should be removed within 24 hours of this notification. Failing which you are liable to be Civil proceedings as per Section 504.

Damages and Claims:I) Section 504 (b) - "The copyright owner is entitled to recover the actual damages suffered by him or her as a result of the infringement".

Mahesh (herein referred to as witness#1) has accepted in writing that he had planned to purchase the lyrics for 10$. But after coming across the lyrics in this blog - http://iamnotinukraine.blogspot.com/ (herein referred to as blog) has decided against buying the lyrics. He won’t be sued because he memorized the lyrics and not downloaded it. This implies that the original owner has suffered a loss of 10$ which can be recovered from you.

But the no of page visits as per the counter in the blog is 1308. We reasonably assume that it implies 1000 unique visitors unless proven otherwise with server logs. Going by the views expressed in the blog, the lyrics are well appreciated and recieved. So it can be assumed that 50% of the visitors were potential customers of the lyrics. Hence the total damages as per Section 504 (b) are 5000$

2) Section 505 - "the court may also award a reasonable attorney's fee to the prevailing party as part of the costs."

The owner of the copyright can claim attorney fees (I am not doing this as social service). Taking into consideration the curret market rates as well as the premium commanded by a respected, wanna be lawyer like me, the cost is tentatively fixed at 1000$ provided there is no appeal by the infringer.

Total Cost: 6000$

However this is under the assumption that this is a first time, non-willful copyright violation. However based on the past blogs (remember the Kill Bill series), you might also be filed under Criminal Offence as per Section 506.

Out of Court Settlement:Considering the fact that the blog was not intended for commercial use, Out of Court settlement is possible, provided the infringer admits the guilt. If given in writing that such offence wont be repeated, the damages can be reduced to 2500$.

When there is a Will, There is a Way:However this is India. As a lawyer, I try to be neutral by accepting money from both the parties. Under the table, pay me Rs. 10000 and I can make this notice will disappear. Remember you get to save 90%. Please hard cash only. Sorry, neither credit card/cheque (I don’t trust them) nor Direct Bank Transfer (I.T.Problems).

Did I hear you say that Ten thousand is too high? Hmm. Well I can give you 50% concession as first time customer. So just pay me Rs. 5000

No please don’t say Rs.5000 is also high. I am being forced to work like an intern. Still I am accepting for Rs.1000.

Normally I don’t barter, however if you don’t have cash ready, I am willing to come down further (I guess this is bcoz in my company, I attended a training titled "Customer Delight"). Atleast pass me some good old Bajjis, simple plain Dosa, Puttu and Parotta (I dont get them here). I want 1 plate each, wrapped in Aluminium foil and delivered piping hot. Please have some mercy, I deserve atleast this for the time and effort required in researching and preparing this "Legal Notice"

Amaam da mahesh!!! but our tamil lyrics has so much yethugai-monai (rhymes) in it. in fact, i jus remembered that starry starry nights of don mclean has so much rhyme in it.

Gwen just rocks... As someone else had pointed out, Bhindi is becos of her boyfriend's Indian origin. She even plays a small role in the film Aviator.
